NOTICE OF SUIT
STATE OF NEW MEXICO to D&E Services, LLC, a Texas Limited Liability Company, Ramon Garcia, Individually, and All Unknown Claimants of Interest in the Premises Adverse to the Plaintiff.
GREETINGS:
You are hereby notified that suit has been filed and is now pending against you in the District Court of Curry County, New Mexico, wherein American Heritage Bank is Plaintiff, and you are Defendants in Cause No. D-905-CV-2023-00402. The object of said suit is to secure judgment against D&E Services, LLC, a Texas Limited Liability Company, and Ramon Garcia, Individually, jointly and severally, in the amount of $185,194.16, principal and interest, together with continuing interest thereafter until paid, reasonable attorney fees, advances and costs of suit.
Said suit is brought to a foreclose a Mortgage covering the following described real estate located in Curry County, New Mexico:
Lot 3 and the South½ less North 2’ of Lot 2 in Block 13 of the G. Clark Smith Addition to the Town of Texico, Curry County, New Mexico, as shown by the official recorded plat thereof a/k/a 612 N. Lamar Street
and for the additional purpose of barring and estopping all of the Defendants named in said suit from having or claiming any lien, title or interest in, to or upon said premises, prior to the lien of Plaintiff by virtue of its Mortgage.
That unless you appear, answer or plead in said cause on or before 30-days after the date of the last publication, Plaintiff will take judgment by default against you for the relief prayed for in its Complaint. That Rowley Law Firm, LLC, Post Office Box 790, Clovis, New Mexico 88102-0790 is attorney for the Plaintiff.
