HEARING NOTICE
Notice is hereby given that the Governing Body, Village of Fort Sumner shall conduct a public hearing during the regular meeting held on Monday, May 11, 2026 at 5:30 p.m. at the Village Hall, 173 E Avenue C, Fort Sumner, NM for the purpose of adopting the following Ordinance in changes of the personnel policy.
The public is invited to attend and to provide written and/or oral comments concerning the proposed ordinance.
AN ORDINANCE
AMENDING ORDINANCE #427, RELATING TO THE VILLAGE OF FORT SUMNER SOLID WASTE SYSTEM FEES:
REPEALING ALL
ORDINANCES AND PARTS OF ORDINANCES IN CONFLICT THEREOF.
ORDAINED BY THE VILLAGE OF FORT SUMNER:
SECTION 1: for the purpose of Defraying the expense of collection and disposal of household waste only, there is hereby assessed a trash collection fee, established by De Baca county for residences, firms, associations, and corporations within the village limits of Fort Sumner. All liability, placement and maintenance of De Baca county owned trash bins placed within the village of Fort Sumner shall be the sole responsibility of the County of De Baca.
Village of Fort Sumner properties having no current occupancy shall be exempt from De Baca County trash collections fees. Village residents shall request exemptions by completing a Declaration of non-solid waster generation for vacated properties. Individuals shall be responsible for keeping the village hall apprised of occupancy changes, or be subject to fines up to five hundred dollars ($500.00), Ninety (90) day in jail, or both per incident plus all applicable court costs that may be assessed. Village code enforcement officer shall monitor exempt properties. Collection of trash fees shall be as follows:
A. Service fee: a $2.00 Service shall be retained by the village of Fort Sumner from each trash collection fee collected for De Baca county.
B residences: each residence shall pay the sum of thirty-seven dollars ($37) to the village of Fort Sumner with set fees being reflected on and charged to monthly utility bill and are subject to the same penalties, cutoffs, and reconnected fees as previously set fourth in water penalty ordinance.(Ordinance no. 393)
C. Commercial: each commercial business shall pay the sum of seventy-two dollars ($72) to the village of Fort Sumner with set fees being reflected on and charged to monthly utility bill and are subject to the same penalties, cutoffs, and reconnected fees as previously set fourth in water penalty ordinance. D. Super commercial: each super commercial business shall pay the sum of one hundred fifty-three dollars ($153) to the village of Fort Sumner with set fees being reflected on and charged to monthly utility bill and are subject to the same penalties, cutoffs, and reconnected fees as previously set Forth in water penalty ordinance. E. All other commercial businesses or establishments not otherwise specified herein: fees shall be negotiated with the village council.
F. Disposal of Demolition Debris (all users): all Demolition waste shall be disposed of at the De Baca county transfer station at fees set Forth by the county of De Baca. Demolition Debris is Defined as uncontaminated solid waste resulting from the demolition of buildings, roads, and other man-made structures including concrete, brick, bituminous concrete, untreated wood, masonry, glass, trees, rock, and plastic.
G. Disposal of construction Debris (all users): all construction Debris shall be disposed of at the De Baca county transfer station at fees set Forth by the county of De Baca.
H. Disposal of green waste (all users): all green waste shall be disposed of the De Baca county transfer station at fees set Forth by the county of De Baca.
Section 2: for the purpose of maintaining the integrity of the solid waste system within the limits of the village of Fort Sumner, the following fines shall bes established and enforced by the village of Fort Sumner.
A. Household waste placed in containers must be secured to prevent the possibility of waste spreading outside the container. Individuals who do not secure household waste placed in containers may be subject to fines up to five hundred dollars ($500), ninety (90) days in jail, or both per incident plus any applicable court costs that may be assessed.
B. Individuals found dumping illegally inside the limits of the village of Fort Sumner or on any village property located outside the city limits may be subject to fines up to five hundred dollars ($500), ninety (90) days in jail, or both per incident plus applicable court costs that may be assessed. Illegal dumping includes the improper dumping of waste and recyclables on private property, public property and around the public works yards, convince station area or any other area Deemed inappropriate for waste disposal.
C. Individuals found to cause the contamination of the recycling of dumpsters, recycling compactors, and/ or recycling receptacle with household waste or other contaminates may be subject to fines up to five hundred dollars ($500), ninety (90) days in jail, or both per incident plus all applicable court costs that may be assessed.
D. Individuals found to cause contamination to household waste containers may be subject to fines up to five hundred dollars ($500), ninety (90) days in jail, or both per incident plus all applicable court costs that may be assessed.
E. Contaminates are Defined as: discarded paint materials and their implements, such as brushes, rollers, trays and paint containers; cleaners in the form of solvents; oils, batteries; pesticides; other leftover portions of materials and implements containing chemicals; petroleum products; and any other materials classified as hazardous waste.
Ordinances and parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
Ordinance no. 438 Shall become effective the last monthly utility billing cycle of fiscal year 2025-26 and each service fee shall increase annually thereafter by 2.5%.
