THE STATE OF NEW MEXICO TO: Any and All Unknown Claimants of Interest Adverse to the Plaintiff.
GREETINGS:
YOU ARE HEREBY NOTIFIED, that suit has been filed and is now pending against you, and each of you, in the District Court of Quay County, New Mexico. Dhillon Fuels, LLC., is the Plaintiff, and you are the Defendants in Cause No. D-1010-CV-2025-00044, that the general object of this lawsuit is to foreclose and to bar and estop all of you, your heirs and assign’s from claiming any right, title or interest in or lien upon the described properties in the Complaint located in Quay County, New Mexico, to-wit:
TRACT I (A): A certain tract of land situate within portions of Section 3 and 10, Township 10 North, Range 34 East, New Mexico Principal Meridian, Village of San Jon, Quay County, New Mexico and being described by metes and bounds as follows:
Beginning at the Northwest corner of the herein described tract, marked by a Rebar with Cap-illegible, whence a tie to the Southwest corner of said section 3, being a Brass Cap, bears S 27°12’52” W., a distance of 1,486.67 feet;
Thence, N 89°27’21” E., a distance of 4477.00 feet to the Northeast corner of the herein described tract, marked by a rebar with cap-illegible;
Thence S 00°32’43” E., a distance of 1314.19 feet to the Southeast corner of the herein described tract, being a point on the Northerly right of way of Interstate 40, marked by a ½” rebar;
Thence, coinciding the northerly right of way of said Interstate 40 the following 3 courses:
S 88°26”13” W., a distance of 3,466.44 feet to a point of curvature, marked by a NMDOT T-rail station 20+40.81;
443.42 feet along an are to the right having a radius of 1065.21 feet a delta of 23°51’03” and a chord of N 79°38’15” W., 440.23 feet to a point of tangency, referenced by a rebar with cap “LS 3789 bearing S 03°36’34” W., a distance of 0.62 feet.
N 67°42’44” W., a distance of 601.84 feet to the Southwest corner of the herein described tract, referenced by a rebar with cap “LS 3789” being S 01°27’56” E., a distance of 1.49 feet;
Thence, leaving said right of way, N 01°27’56” W., a distance of 1460.89 feet to the point of beginning; being the exact same land described as Tract II of Special Warranty Deed recorded May 5, 1998 in Book 122, Pages 650-653, Warranty Deed Records, Quay County, New Mexico.
Tract I (B): A certain tract of land situate within portions of Sections 3 and 10, Township 10 North, Range 34 East, New Mexico Principal Meridian, Village of San Jon, Quay County, New Mexico and being described by metes and bounds as follows:
Beginning at the Northeast corner of the herein described tract, marked by a Rebar with Cap-illegible, whence a tie to the Southwest corner of said section 3, being a Brass Cap, bears S 27°12’52” W., a distance of 1,486.67 feet;
Thence, S 01°27’56” E., a distance of 1460.89 feet to the Southeast corner of the herein described tract, being a point on the northerly right of way of Interstate 40, referenced by a rebar with cap “LS 3789” bearing S 01°27’56” E., a distance of 1.49 feet;
Thence, coinciding said right of way, the following three courses: N 67°42’44” W., a distance of 479.74 feet to a pint of curvature, referenced by NMDOT T-rail 215+94.67 bearing S 16°14’45” W., a distance of 2.82 feet;
167.64 feet along an arc to the left, having a radius of 425.00 feet, a delta of 22°36’01” and a chord of N 79°26’40” W., a distance of 166.56 feet.
S 89°15’19” W., a distance of 52.08 feet to a rebar with cap “LS 3789”to the Southwest corner of the herein described tract to the Easterly right of way of NM State Road 469:
Thence, leaving said Interstate right of way and coinciding the said easterly right of way of NM State Highway 469, N 01°33’14” W., a distance of 1242.89 feet to the Northwest corner of the herein described tract:
Thence, leaving said right of way, N 89°27’21” E., a distance of 656.08 feet to the point of beginning: being the exact same land described as Tract I of Special Warranty Deed recorded May 5, 1998 in Book 122, Pages 650-653, Warranty Deed Records, Quay County, New Mexico.
LESS and EXCEPT that certain property described in Warranty Deed recorded April 2, 2019 at 4:05 p.m., as Document 21904020008, Records of Quay County, New Mexico.
Tract II: Commencing at the Northeast Corner of Lot Nine (9) of Subdivision a/k/a* of the Southeast Quarter of the Northeast Quarter (SE/4NE/4), Township Ten (10) North, Range Thirty-four (34) East, NMPM, which pint is the West Boundary line of State Highway No. 467 (formerly State Road 30), thence West 100 feet, thence South 75 feet, thence East 100 feet, thence North 75 feet to the point of beginning LESS and EXCEPT a Tract of land conveyed to the State Highway Department of New Mexico in that certain warranty Deed recorded November 1, 1977, in Book 100, Page 321, Warranty Deed Records, Quay County, New Mexico. *a tract in Walker addition known as part of Tract 9
Tract III: All of Tract No. Nin (9) of the Walker Addition to the Village of San Jon, New Mexico, as shown by Plat on file in the office of the County Clerk of Quay County, New Mexico;
Less and Except: A tract in the Northeast corner 100 feet by 75 feet as shown in Vol. 65, Page 624, of Warranty Deed Records, Quay County, New Mexico;
And Further Excepting a Tract consisting of 1,185 square feet, as shown on Vol. 100, Page 319, Warranty Deed Records, Quay County, New Mexico;
And further Excepting a Tract consisting of 707 square feet as shown in Vol. 100, Page 321, Warranty Deed Records, Quay County, New Mexico.
Tract IV: A 0.484 acres tract of land, being the East part of Tract 12 which is recorded in a court “order adjusting boundaries” as Document No. 201309250009 being out of the East ½ of Section 10, T-10-N, R-34-E, N.M.PM., Quay County, New Mexico and being described by metes and bounds as follows:
(B1) The point of beginning is a ½” rebar topped with a red plastic Surveyor’s cap stamped “Kelly RPLS 5534” (Hereinafter referred to as a K-cap) set in the North R-O-W line of East Main Street (Old Route 66) whence a railroad iron R-O-W monument bears S. 89°43’33” W., a distance N.00°27’33” W., 88.41 feet from this R-O-W monument;
(B2) Thence, N. 00°33’00” W., a distance of 192.83 feet to a K-cap set for the Northwest corner of Tract “B” and the Northeast corner of Tract “A”;
(B3) Thence, N.89°01’25” E., a distance of 109.76 feet to a K-cap set for the Northeast corner of Tract “B”;
(B4) Thence, S. 00°04’42” E., a distance of 194.17 feet to a K-cap set in the North R-O-W line of East Main Avenue (Old Route 66) for the Southeast corner of this tract;
(B5) Thence, S. 89°43’33” W., along the North line of East Main Avenue (Old Route 66) a distance, 108.16 feet to the point of beginning.

as shown by the official recorded, and referred to herein as the “Subject Property”.
And further to establish the Plaintiff, Dhillon Fuels, LLC., to be the owner in fee simple of said real estate, and to forever quiet and set at rest their title thereto.
The purpose of this action is also to extinguish any and all other claims of interest by each and all of the named Defendants in, to or against the above-described real property.
Please be further advised that unless you, and each of you, appear, answer or plead in said cause on or before thirty days after the last publication of this Notice, Plaintiff will take Judgment by Default against you for the relief prayed for in its Complaint to Foreclose Transcript of Judgment and Quiet Title; and that DOERR & KNUDSON, P.A., 212 West First Street, Portales, NM 88130 are the attorneys for Plaintiff.
